Legal Issues for Divorced Parents in the Time of COVID-19

On this episode of the savvy parent podcast, we’re joined by Jennifer Kouzi from Kaminer, Kouzi & Associates LLP. Jennifer specializes in assisting her clients with divorce, and she wears several hats in her work. She may help coach her clients through the preparation and process of divorce, she can act as a mediator through the process of divorce, or she can represent her clients as a lawyer if divorce proceedings go to court. She joins Shannon McNulty to discuss the issues that divorced parents are experiencing in the time of COVID-19. 

The challenges of COVID-19

All parents are experiencing challenges due to COVID-19 but going through a divorce or being a divorced parent during this time can make things much more complicated. Jennifer discusses the particular problems that divorced parents may face that are unique due to COVID-19 such as issues emerging around when and how kids transition from one parent to the next, changes of income from job loss, and the fact that parents just may not agree when it comes to the level of risk they’re willing to take with their children. Shannon also reminds us that if you do go through a divorce, it’s critical to revisit your estate plans (or to create them) to make sure you and your children are protected.

In addition to the challenges, the courts in New York initially closed down as COVID-19 emerged, and though are open again, they are not hearing non-emergent issues. This means it’s harder for divorced parents to get their needs handled in the court system and Jennifer shares how to navigate this.

Improving communication is key

Given that most issues won’t be able to be seen in court right away, it becomes even more important that former spouses are communicating well with each other. Improving communication, and/or going to mediation allows parents to address their changing needs and can assist in coming to decisions around adjustments to existing custody arrangements.
